1. Overview
Clarivize, Inc. ("Clarivize," "we," "our," or "us") respects privacy. This Software Privacy Policy explains how we collect, use, retain, and disclose personal data in connection with our service telemetry processing software (the "Software"), including software purchasing and payment interactions and the limited telemetry generated about the Software's own operation and configuration.
The Software is offered to business customers and is designed to run within the customer's environment. Accounts, if enabled, are created locally within that environment. Except for the limited Clarivize telemetry described in this Policy, information processed within the customer environment remains under the customer's management.
This Policy does not apply to information that a business customer processes in its environment through the Software. For that information, the customer determines the applicable privacy practices and should provide any required notices. It also does not apply to a third party's independent handling of personal data, including a payment processor's handling of payment information.
2. Personal Data We Collect
"Personal data" means information that identifies, relates to, describes, or could reasonably be linked to an identified or identifiable individual.
In addition to Personal Data, Clarivize may collect certain operational, configuration, performance, and usage statistics regarding the Software, such as software telemetry data, configuration statistics and information, processing volume, reduction metrics, resource utilization metrics, and similar technical information ("Operational Data"). Operational Data is not intended to identify, relate to, describe, or reasonably be linked to an identified or identifiable individual and is not treated by Clarivize as Personal Data.
We collect the following limited categories in connection with the Software:
- Purchasing and billing information. Name, email address, phone number, company or organization, billing contact information, transaction history, tax identifiers, and financial account or payment information used to process a purchase. A payment processor may collect and process payment information on our behalf or independently under its own privacy terms.
- Software telemetry and configuration statistics. Statistics about the Software's configuration and telemetry concerning the Software's own performance. This information is limited to Clarivize's software performance and configuration and is not intended to include customer content, prompts, uploads, files, or customer application logs.
- Software-related website cookies. Cookies or similar identifiers may be used when a person visits a Software-related page on clarivize.io. We do not use third-party advertising pixels, tags, SDKs, or analytics tools to collect personal data from the Software or covered Software pages.
We do not knowingly collect government-issued identification information, precise geolocation, biometric or genetic data, health or consumer health data, sensitive demographic information, or personal data of minors through the Software. Financial account information is collected only as needed for payment processing.
3. How We Collect Personal Data
- Directly from you or your business, such as when purchasing the Software, providing billing details, or contacting us about the Software.
- From a payment processor, in connection with a Software purchase. Clarivize has not yet selected a payment processor; this Policy should be updated when one is selected.
- Through cookies or similar identifiers on Software-related pages that link to this Policy.
4. How We Use Personal Data
We use personal data only for the following Software-related purposes:
- To provide, operate, support, and improve the Software, including by evaluating the Software's own performance and configuration.
- To process Software purchases, payments, billing, transaction records, and applicable tax information.
- To communicate with business customers about the Software and respond to Software-related inquiries.
- To maintain records, enforce applicable agreements, protect the Software and our rights, and comply with legal obligations.
We do not use personal data collected under this Policy for targeted advertising, cross-context behavioral advertising, or the sale of personal data. We do not use sensitive data for advertising, profiling, automated decision-making, AI model training, product development, analytics, or personalization.
5. Operational Data We May Collect
Clarivize Software may collect Operational Data, such as software telemetry data, configuration statistics and information, processing volume, reduction metrics, interface interaction statistics, resource utilization metrics, and similar technical information.
This type of data is intended to be anonymous technical data that helps us improve our software, and is never shared with third parties.
Upon request, Clarivize can provide license keys or configuration settings that prevent our Software from collecting Operational Data.
6. Cookies and Similar Technologies
Clarivize does not use third-party advertising technologies or behavioral tracking in connection with the Software. Because we do not sell personal data or use it for targeted advertising, an opt-out preference signal generally does not change these practices.
7. How We Disclose Personal Data
We do not sell personal data or share it for targeted advertising. We may disclose the personal data described in this Policy only as follows:
- Payment processing. To a payment processor selected to complete Software purchases, facilitate payments, and maintain transaction records. The processor may handle payment data under its own privacy terms.
- Service support. To contractors or service providers only when reasonably necessary to support the Software-specific activities covered by this Policy and subject to appropriate confidentiality or data-use restrictions.
- Legal and safety purposes. To comply with law, legal process, or government requests; enforce agreements; or protect the rights, property, or safety of Clarivize, our business customers, or others.
- Business transactions. In connection with an actual or proposed merger, financing, acquisition, reorganization, bankruptcy, or sale of assets, subject to applicable law.
- At your direction or with consent. To fulfill the purpose for which information is provided, or as otherwise directed or authorized by the affected person or business customer.
We may disclose aggregated or de-identified information that cannot reasonably identify an individual, subject to applicable law.
8. Customer-Managed Environments
The Software runs in a business customer's environment. The customer manages information stored or processed there, including local accounts, access settings, data in transit, and other customer-controlled security and retention choices. Clarivize does not store customer-environment data at rest as part of the Software service, other than the limited Software telemetry and configuration statistics described in this Policy.
If you submit a privacy request concerning information maintained by a Clarivize customer in its environment, you should direct the request to that customer. If appropriate, we may refer you to the customer or assist the customer as required by contract or law.
9. Data Retention
Clarivize retains the Software's statistical configuration and performance data for one year and then deletes it. Payment information and related records are retained by the applicable payment processor in accordance with its practices and applicable law. We may retain limited billing or transaction records for longer when required by law, needed to establish or defend legal claims, or necessary to resolve disputes.
10. Data Security
Access to the limited Clarivize telemetry is restricted through role-based access controls. The Software does not retain customer-environment data at rest as part of the service. Encryption of data in transit and other controls within the customer environment are customer managed. No system or transmission method is completely secure, and we cannot guarantee absolute security.
Because the Software operates in the customer's environment, customers are responsible for configuring and maintaining appropriate administrative, technical, and physical safeguards for their environments, accounts, and information.
11. Children's Privacy
The Software is offered to businesses and is not intended for individuals under 18. We do not knowingly collect personal data from minors through the Software. If we learn that we collected personal data from a minor through the Software, we will delete it as required by applicable law.
12. Privacy Rights and Choices
Depending on where you live and subject to applicable exceptions, you may have rights regarding personal data that Clarivize controls, such as rights to request access, correction, deletion, or a portable copy. You may also have the right to appeal certain decisions where applicable law requires an appeal process.
To submit a request concerning personal data controlled by Clarivize under this Policy, email privacy@clarivize.io. Please describe your request and provide enough information for us to identify the relevant records and reasonably verify the request. We may request additional information for verification, and an authorized agent may submit a request where permitted by law. We will respond as required by applicable law.
Clarivize does not sell personal data or process it for targeted advertising or qualifying profiling. Nevada residents may nevertheless use the email address above to submit a request regarding a future sale of covered information. Clarivize does not currently sell covered information as defined by Nevada law.
13. United States Scope
The Software is offered to business customers in the United States. Clarivize does not offer the Software to individuals in the European Union or European Economic Area, intentionally market to those residents, monitor their behavior, or process their personal data on behalf of business customers under the practices described in this Policy. If these practices change, we will review and update this Policy as appropriate.
14. Third-Party Services
A third-party payment processor or another third-party service may have its own privacy policy and practices. This Policy does not govern information that a third party collects or controls independently. We encourage you to review the applicable third party's privacy notice before providing personal data.
15. Changes to This Policy
We may update this Policy from time to time. We will post the updated Policy on the Software or the Software-related page that links to it, update the effective date above, and provide any additional notice required by applicable law.
